Parties: [Product Maker] ("Maker"), [Regional Retailer] (“Retailer’)and [Buyer Name] ("Buyer")
This Agreement governs the purchase of:
* Digital Products: Downloadable content (e.g., software, ebooks, media, tickets).
* Physical Products: Tangible items requiring shipping and handling.
* Access: Digital products are deemed delivered once the Seller provides the access link or download code, typically within 48 hours of payment.
* Licensing vs. Ownership: Per 2026 digital transparency regulations, the "purchase" of a digital product is a limited, non-exclusive license to access the content, not a transfer of ownership.
* Revocation: If the Seller loses the right to distribute the content, access may be revoked.
* Usage Restrictions: Digital products are for personal, non-commercial use unless a separate commercial license is purchased.
* Maker Responsibility: To collect all fees related to delivering products. Muezbiz, LLC is not responsible for any freight costs or damages to products in transportation.
* Maker Responsibility: The Maker is solely responsible for all preparation, labeling, and shipping of physical goods. For marketplace sellers (e.g., Muezbiz, LLC), the Maker must provide valid tracking information.
* Packaging Compliance: Sellers must comply with 2026 "Extended Producer Responsibility" (EPR) laws, ensuring packaging meets state-specific recycling and safety requirements.
* Risk of Loss: Title and risk of loss pass to the Buyer upon delivery to the common carrier.
* Total Cost: Buyer agrees to pay the price listed at checkout, including applicable taxes based on the delivery jurisdiction.
* Price Changes: Sellers must provide 7–30 days' notice for any price changes affecting ongoing subscriptions or recurring orders.
* Digital Goods: Due to the instant nature of downloads, digital products are generally non-refundable once the download has been initiated.
* Physical Goods: Returns for physical goods must be requested from the product Maker within 30 days of delivery. Items must be returned in original packaging.
* Data Rights: Maker will process personal data solely to fulfill the order. Under 2026 state privacy laws, Buyers have the right to request access, correction, or deletion of their data.
* Retention: Maker shall maintain verification of the Buyer's affirmative consent for at least three years.
* "As Is" for Digital: Digital products are provided "as is" without warranty of continuous uptime.
* Maker’s Limited Warranty (Physical): Physical goods are warranted to be free from material defects for 365 days from shipment.
* Indemnity: Sellers and Makers shall indemnify the Buyer against third-party intellectual property claims arising from the use of the product.
By clicking "I Agree" or completing the transaction, the Buyer acknowledges:
1. They are receiving a license for digital goods, not ownership.
2. They have read the specific restrictions of that license.
4. They understand the Seller’s fulfillment timelines for physical items.
